BOOKING TERMS & CONDITIONS
YOUR BOOKING 
You must be 18 years or over when making your booking.

BARNETT BAKER reserves the right to refuse any booking prior to issuing any confirmation in writing. When you receive your Booking Confirmation you must check all the details carefully for accuracy and contact us immediately if you find any discrepancy.
Upon receipt of a Booking Form, BARNETT BAKER will put together a unique package and itinerary to meet all your needs. Upon agreement and acceptance of this package, BARNETT BAKER will reserve this offer for a period of 14 days, within this time you must return your signed Agreement to the Terms & Conditions and make payment of the Deposit Amount or Full Payment as required to confirm your booking. 
DEPOSITS - This can be calculated as a total or per person, based on your preferences and will usually be at the rate of 30% unless otherwise stated. If after the 14 days Highland Lodges have received no further directive, or response we will deem the booking to be cancelled.
* PLEASE NOTE THAT ALL DEPOSITS PAID ARE NON-REFUNDABLE *
Upon receipt of the signed Booking Confirmation and Terms & Conditions (electronically or physically) and the Deposit or full payment, you will be deemed to have accepted these terms and conditions and their application to your unique booking. 
BARNETT BAKER will accept payment in the form of cheque (made payable to BARNETT BAKER), or bank transfer, details of the account will be provided. 

The Booking Confirmation and advice of amount due will be sent to you along with, where applicable, a planned itinerary confirming details of your unique booking (accommodation, travel and any activity arrangements). These details will be sent upon receipt of the signed Booking Confirmation, Terms & Conditions and payment of Deposit or full amount as required at the time of booking. A contract will then exist between you and BARNETT BAKER.  
The Balance of Payment is due not later than10 weeks before the first day of the “Start Date” or “Event Date” on your Booking Confirmation. If full payment is not made within the said period of 10 weeks, the booking will be deemed to be cancelled. 
If you make your booking within 10 weeks of the “Start Date” or “Event Date” you are required to make Full Payment at the time of Booking. 

PRICES 
Price quotes are as a TOTAL (quotes per person can be provided on request) for your unique booking or event. All prices are provided in GBP£ (Sterling). Additional bank charges may be incurred for payments made in Foreign Currency. Any such charges will be advised prior to Invoicing.
INCLUSIONS IN YOUR BOOKING
All will be as detailed in your Booking Confirmation and may include the following:
* Meals | Accommodation | Activities | Transport | Event Services & Staff | Meeting facilities & equipment

EXCLUSIONS TO BOOKING
There may be some aspects of your booking or event that are not included. These will be highlighted to you and may often include the following:
* Round-trip transportation between home city and your Booked Venue/Event or arrival port in Scotland (if travelling from outside the country)
* Wines, Champagnes, Spirits and any other alcoholic beverages 
* Gratuities (discretionary)

CANCELLATION POLICY
If, through circumstances beyond your control, you are compelled to cancel your Booking, you should immediately notify BARNETT BAKER and confirm the cancellation in writing. If cancellation is made more than 10 weeks before the “Start Date” or “Event Date” only the deposit will be lost. 
IMPORTANT – Cancellations made within 10 weeks of the “Start Date” or “Event Date” will NOT be entitled to ANY refund of monies paid and also become liable for any unpaid balance due at that time. BARNETT BAKER will make every effort to reduce the full costs or re-sell your booking where possible, however, there are no guarantees that this will always be possible.

ALTERATIONS AND AMENDMENTS 
BARNETT BAKER will make every effort to provide all elements once you have made a booking. We do, however, reserve the right to make minor amendments to the Booking and will inform you as soon as possible of any such amendments. It is hoped that no cancellations or amendments need to be made to your booking in anyway, however, as unforeseen problems do occur, we will contact you immediately to discuss any proposed cancellation or adjustment. If the circumstances affect your desired location, accommodation or activities, BARNETT BAKER will endeavour to find an alternative and similar at a relative rate. If this alternative is unacceptable to you, we will refund your original payment.

CHANGES TO BOOKING MADE BY YOU
Should you wish to change or amend your reservation once BARNETT BAKER have received the signed Booking Confirmation, within reason, we will try to accommodate the changes where possible. In the event changes are not possible to accommodate, we will inform you of this as soon as possible. In this case BARNETT BAKER may have to treat the booking as a cancellation which would then be subject to the Cancellation Policy as detailed above. 

DESCRIPTION OF SERVICES 
All descriptions of the Service are published in good faith and are accurate at the time of going to press. However please note that changes can occur. Any complaints or criticisms about the Booking must be taken up with BARNETT BAKER immediately and within 24 hours of the time of the difficulty or shortcoming becoming apparent. If capable of remedy, BARNETT BAKER will use all reasonable endeavours to remedy the difficulty or shortcoming. If you remain dissatisfied, you must write to BARNETT BAKER within 7 days of the incident with which you are dissatisfied. BARNETT BAKER will then use reasonable endeavours to further investigate the complaint and will report back to you with any offer of redress which BARNETT BAKER, in their sole discretion, deem to be appropriate in the circumstances. 

RIGHT TO REFUSE ENTRY 
BARNETT BAKER reserves the right to require all or any persons to leave any premises booked on their behalf, without refund, which they consider to be in breach of these conditions. This includes persons who cause a nuisance or damage to premises or conduct themselves in an offensive or disorderly manner. In such an event BARNETT BAKER will not be liable for making any payment to you and will retain all monies paid. 

ACCOMMODATION (if provided)
Any contract made by BARNETT BAKER and their clients in terms of exclusive use properties for accommodation, is NOT of landlord and tenant. This Accommodation is provided purely as a “Holiday Let” in accordance with the Rents Act. The number of guests permitted to stay in any accommodation shall not exceed the maximum number of persons as stated on the Booking Confirmation. If the numbers exceed the Booking Confirmation guest numbers, all guests may be asked to leave the premises with no refunds paid.

YOUR RESPONSIBILITIES
Clients of BARNETT BAKER are obliged to take reasonable care of any accommodation booked on their behalf. If undue care or damage to any of the properties arises, BARNETT BAKER reserves the right to make an additional charge for cleaning costs or damage repair. Hotels and Holiday Houses will also operate their own Conditions to guests which must also be adhered to. For most exclusive use properties, a Good Housekeeping Deposit (GHD) is required to be paid directly the property owners. This is held by them and returned to you after inspection of the property at the end of your agreed length of stay.

RISK 
In so far as may be permitted by law, no responsibility will be accepted by BARNETT BAKER, or any of their agents whomsoever for any injury, accident or damage to persons or property, or loss or theft thereof arising howsoever or wherever, other than in the case of the fault or negligence of either BARNETT BAKER or their employees or agents. 

OUR RESPONSIBILITIES
BARNETT BAKER accept reasonable responsibility for their clients from the “Start Date” or “Event Date” until the “End Date”. Highland Lodges shall not be or become liable or responsible in any way for loss, injury or damage to or in respect to any person or property during activities provided by other service providers.

YOUR RESPONSIBILITIES
Baggage and personal effects are the sole responsibility of their owners at all times.  Persons travelling to, from or in the UK prior to or after these dates do so at their own risk and discretion.

FORCE MAJEURE 
Your booking is accepted on the understanding that, the Booking arranged for you for the period specified on the Booking Confirmation, is done so in good faith, if it should be or become impossible due to circumstances beyond the control of BARNETT BAKER or their providers, you shall be entitled to a refund of not more than the amount paid by you for the Booking. In particular, but without limitation, BARNETT BAKER cannot, at any time, accept responsibility for any losses, injuries, inconvenience or expenses caused to you by acts of terrorism, war, riots, industrial action, floods, fires, delays or weather conditions or the threat of any of these. 

INDEMNITY 
You will indemnify BARNETT BAKER against loss, damage or injury sustained to property or persons as a result of any breach of these conditions by or arising through the fault of you or any member of your party. 

VISAS AND PASSPORTS 
Any non-British Citizens are required to make their own arrangements to ensure that they have current passports and any required visas to visit the United Kingdom. 

GDPR POLICY - DATA PROTECTION ACT - PRIVACY STATEMENT 
Full details of our GDPR Policy can be provided to you on request and are available on our website. Information requested by BARNETT BAKER in terms of these conditions will only be used by us for the purposes of providing you with your Booking, updating customer records, or contacting you directly for marketing or research purposes. Only relevant information will be passed on to agents used to provide services in connection with your Booking.

HOLIDAY, TRAVEL and other relevant INSURANCES 
IMPORTANT - We expect you to arrange your own insurance cover as required prior to leaving home.
When making your booking with BARNETT BAKER you may be required to travel by sea or air to reach your final destination. Now and again things can go wrong, for example, fog can result in cancelled or delayed flights, or severe weather can affect the timings of your ferry or travel plans. 
For all BARNETT BAKER bookings, we strongly recommend that you take out your own full Insurances, covering risks such as cancellation and delay.

LAW 
Save as otherwise provided herein, these terms shall be governed by and construed in accordance with Scots law and the parties hereby propagate the non-exclusive jurisdiction of the Scottish courts.
